Detached dwellings in Spurstow rejected again

Outline plans for two detached dwellings in South Cheshire would not be in an appropriate location for infill residential development, a planning inspector believed.

The appeal arose at The Gables, Peckforton Hall Lane, Spurstow. Applicant Mr J Gaskell lodged the proposal with planning officers at Cheshire East Council but the council failed to give notice of their decision within the prescribed period.

Mr Gaskell appealed following which the council detailed two proposed reasons for refusal. Inspector J Hobbs found the main issues were whether the site was an appropriate location for the proposed development, including the accessibility of services and the effect of the proposed development on the character and appearance of the area.

It was not disputed the site was considered to be located within an area of open countryside where only development essential for the purposes of agriculture and other uses appropriate to a rural area would be permitted.

Exceptions included limited infilling in villages and the infill of a small gap with one or two dwellings in an otherwise built up frontage. Spurstow was not identified as an infill village and the properties would lead to the loss of open countryside.

There were 'a very limited number of services' within walking distance and there was no street lighting within the immediate surroundings. It was likely that future occupiers would be 'heavily reliant' on private vehicles to access day-to day services outside of Spurstow.

The appeal scheme included the provision of only two family dwellings, a minor increase in the local population, which was unlikely to lead to a discernible improvement in the vitality of local services. The inspector concluded the scheme was not an appropriate location for the proposed development.

It would lead to the urbanisation of a currently undeveloped area although the proposed dwellings would respect the size and design of The Gables and other two storey properties along Peckforton Hall Lane.

There would not be harm to the character and appearance of the area but the proposed new build would conflict with the development plan when considered as a whole.

The inspector concluded the appeal should be dismissed.
